We have assisted many asbestos disease sufferers and their families with claiming compensation. Below are some of the questions we are regularly asked when we go out to see people.
The company I worked for is no longer around, can I still make a claim?
We may be able to assist you even if the company you were employed by has long since ceased trading.
When putting forward a civil claim for compensation, even if the company which formerly employed you is
not trading, if we are able to trace their former employer liability insurer, we may still be able to help you.
We have access to a wide range of databases which hold records of historic insurance details for
How much compensation will I receive?
The amount of compensation you receive will depend on what asbestos related condition you have been
diagnosed with and the effect that it has or is likely to have on your daily living.
Lots of different things can influence the amount of damages you may receive including your age, the
length of time you have been suffering from the symptoms of your illness, whether you have undergone
invasive surgical procedures as a result of your diagnosis and the level of care and assistance you may
As your claim progresses we will be able to give you an indication of the likely level of damages you may
How long will the claim take?
Much will depend on how quickly it is possible to trace the former company that you worked for and if they
are not still trading, whether it is possible to trace their former employer liability insurance details. We aim
to complete our initial investigations as quickly as possible so we are able to let you know whether your
claim is likely to proceed.
How much will it cost to make a claim?
We guarantee to our clients if we are acting under a no win no fee agreement that we will not ask for any
money as the claim progresses. If your claim is successful we are able to obtain your legal costs from the
Defendant in addition to your compensation for your illness. Therefore if we are acting under a no win no
fee agreement it will not cost you anything to put forward a claim.
I don’t know where/how I was exposed to asbestos dust, what should I do?
We understand it is an uncertain and worrying time when you have been diagnosed with an asbestos
related disease. We appreciate you may not immediately be able to pinpoint where you have been
exposed to asbestos dust. Our specialists will come and visit you in your own home and we will take the
time to discuss your work history and your circumstances with you in detail. We have a wide knowledge of
the different materials which unbeknown to many contained asbestos fibres.
Will I have to go to Court?
Most probably not. It is very unlikely (but not impossible) that you will have to go to Court. The vast majority
of asbestos injury claims settle without going to trial. We try where possible to achieve out of court
settlements for sufferers and their families.
What if I die before the claim is sorted?
Naturally people want to be assured of what will happen in this unfortunate situation. If sadly a sufferer
dies as a result their asbestos related illness before their claim is finalised then the claim will continue on
behalf of the sufferer’s Estate. We are able to act for your Estate on the same basis that we have acted for
you on a no win no fee basis. Therefore your loved ones and/ or executors will not be put to any costs in
continuing the claim.
