What is the Diffuse Mesothelioma Payment Scheme (DMPS)?
The DMPS is a government scheme which is designed to compensate people with mesothelioma who have not been able to bring a civil claim for compensation against either their former employer, or, their former employer’s Employer Liability Insurer, because the employer has gone out of business and their Employer Liability Insurer cannot be traced.
Who is eligible to apply for a payment under the Scheme?
To be eligible for a payment under the scheme you must have been exposed to asbestos by your employer, either negligently, or, in breach of statutory duty. In addition you must have been diagnosed with mesothelioma after 25th July 2012.
Our asbestos specialists at Larcomes will be able to advise you if you may be eligible for a payment under the scheme.
How much will I receive?
If your application is successful, you will be awarded a payment based on an age-related tariff system. For example, at the time of printing, if you were aged 70 when you were diagnosed with mesothelioma the payment would be £128,548.00. This payment includes a £7,000.00 contribution towards your legal fees.
Is it only mesothelioma sufferers who can apply under the scheme?
No, if either a relative or someone you depend on financially has died from mesothelioma then you may be eligible to apply for a payment under the scheme as a dependant. The sufferer must still have been diagnosed with their mesothelioma after 25th July 2012 to be eligible and they must not have made a successful DMPS or civil claim during their lifetime.
If you are not certain whether you may be able to apply for a payment, please contact us and we can advise you.
Who is classed as a Dependant?
A relative or person who is financially dependant on the sufferer at the time of the sufferer’s death. If you are not certain if you are classed as a Dependant our specialists can advise you.
