Asbestosis Claims

Asbestosis is a serious lung condition caused by scarring of the lungs due to inhaling asbestos fibres due to heavy exposure to asbestos dust during employment. This damage causes the lungs to lose elasticity resulting in breathing difficulties.

Asbestosis is the most widely known disease associated with excessive asbestos exposure of many months and years.

The symptoms of asbestosis can take around between 20-50 years or more from the initial exposure to asbestos to manifest themselves.

Whilst the main symptom of asbestosis is shortness of breath, other symptoms include a dry crackling sound while breathing, clubbing of the fingertips and toes, chest pain, tightness around the chest, an unexplained persistent dry cough and even in some cases appetite loss.

Asbestosis is linked to those working in industries such as thermal insulation, shipbuilding, and heating.

Can I Make a Compensation Claim for Asbestosis?

If your diagnosis has been within the last three years, and you believe your asbestosis is due to occupational exposure to asbestos dust and fibres then you may be able to make a claim for industrial disease.

Asbestosis cases can be complicated both on a medical basis and on the evidence of asbestos dust exposure.

In asbestosis cases, the law requires that the link between fibrotic changes to the lung and exposure to asbestos dust is proven on the balance of probabilities and this requires evidence that the Claimant has been exposed to more than 25 fibre millilitre years of asbestos dust.

While this may sound difficult our experienced team are well used to dealing with the medical and legal arguments that are needed in these cases.

You should also be aware that the 3-year limitation period for starting a compensation claim for an asbestos-related disease starts from the date you were first told that you had been diagnosed with the disease, rather than when you were exposed to asbestos.

What Compensation Am I Entitled to For Asbestosis?

The level of compensation that you may be entitled to depends upon the respiratory disability that the asbestosis is causing and what your prognosis is likely to be in respect of any future progression of your asbestosis.

Again, our experienced team can guide you through this and the options available to you in respect of settling any claim.

Along with making a claim for compensation, there are also a number of benefits available to people who have asbestos-related diseases, including a one-off payment which you may be entitled to, under the Pneumoconiosis Etc. (Workers’ Compensation) Act 1979.

Our experienced team will be able to guide you through all the benefits and payments that may be available to you and explain the process of making a claim for compensation.

No Win – No Fee Asbestosis Compensation Claims

Larcomes are happy to investigate your asbestos-related illness claim without any obligation. In most cases we offer no win – no fee agreements which give you the peace of mind that you are not going to be lumbered with any legal bills from pursuing your claim. This is a funding solution, sometimes known as a ‘conditional fee agreement,’ which means that you do not have to pay anything up front for your legal fees and that, if your case is unsuccessful, you will not be responsible for any of the legal fees. These will normally be covered by way of a legal expenses insurance policy which your solicitor will discuss with you at the start of your case.

If your case is successful, the legal fees and other costs incurred are paid by the insurers of the other party and not by you.

We understand that is a worrying time if you or if a family member has been diagnosed with an asbestos- related illness.
